Woman struck by train sues railroad

A Jeannette woman who was slightly injured after being struck by a train while walking along railroad tracks sued Norfolk Southern Corp. Thursday for failing to warn pedestrians that trains travel on tracks.

"Defendant's failure to warn plaintiff of the potential dangers negligently provided plaintiff with the belief she was safe in walking near the train tracks," the suit states.


I almost understood when McDonalds was sued because their coffee was "very hot", but this completely evades my understanding.

If a person is not capable of basic cognitive thoughts such as, "Trains travel on train tracks and trains are dangerous," then they are likely incapable of reading a sign that says the same.

"The [engineer] did not stop the train in a timely manner, and failed to yield the right of way to a pedestrian walking along the tracks in plain view," the suit says.


The train did not stop in a timely manner? What do they define as a timely manner for a train? Before it hits someone? Lets be serious here. Trains do not stop on dimes.

This lady's lawyer should be taken out and shot. He is a serious threat to the law. His fellow lawyers should jump his sorry butt and beat it black and blue.

This just give a bad name to all the legitimate lawsuits out there.

What's going to happen is that the train company will settle out of court instead of fighting it. Cheaper for the company in the long run.
